Stop smoking in public places or face a penalty

The Smoke-free Premises etc. (Wales) Regulations 2007 (The Smoking Ban in Wales) came into force on 2nd April 2007.

The new law applies to most (enclosed / substantially enclosed) public places including "public" transport vehicles and vehicles used by 2 or more employees for work. 

Very few exemptions apply.

Penalties range from £50 (fixed) up-to £200 for individuals who breach the law

The manager or person in charge of the premises could be fined £200 (fixed) to £1000 for failing to disply an approved "No Smoking" sign and up-to £2500 for failing to prevent others from smoking

The new law banning smoking in enclosed public places in Wales comes into effect on 2 April 2007. The smoking ban legislation seeks to protect people in public places from Second Hand Smoke - the harmful effects of which are well known.

Three Offences are created by the new legislation:

  1.. Failure to display a No Smoking Sign (in applicable premises - see below)
  2.. Smoking in a Smoke Free place
  3.. Failing to Prevent Smoking in a Smoke Free place

The new measure affects virtually all public premises, for example:

Bars
Cinemas
Enclosed Workplaces
Public Transport
Public Houses
Restaurants
Shopping Malls
Shops
